What is a digital signature?

 

Faster processes, greater legal certainty, digital workflows – the (timely) signing of contracts should not be left to chance.

When will the post finally arrive with the urgent contract? Who is responsible for signing it within the company? Have we received confirmation yet that the signed contract has been returned to the other party?

Authorisation to sign, monitoring deadlines, postal delivery times – these are issues that create organisational burdens when it comes to important contracts and regularly give rise to (temporary) legal uncertainty.

This is particularly problematic in the case of contracts which must be concluded in good time not only in the contracting parties’ own interests, but also in accordance with legal requirements – such as the temporary agency work contract in the temporary employment sector. Under the law, the temporary employment contract must be signed before the project staff member starts work. In the case of last-minute requests, this can involve a considerable amount of effort, as the postal delivery time is too long, the start of work is on the early shift, etc.

 

How digital signatures work

 

A distinction is first made between simple and qualified digital signatures.

One simple electronic signature does not constitute proof of the identity of the person depicted. This could, for example, be a scanned signature or the signature in an email (the so-called email footer).

The qualified digital signature is, however, based on identity verification. This digital signature allows signatures to be transmitted digitally and is equivalent to a handwritten signature.

With a qualified digital signature, a signature is generated using the signatory’s private key when the user signs a document electronically. The private key is kept secret by the signatory. A mathematical algorithm functions like a cipher, generating data relating to the document in question – known as a „hash“ – and encrypting the data. The result is encrypted data and the digital signature. In addition, the signature is provided with a timestamp. If the document is altered after it has been signed, it is invalid.

  1. Identification by entering your mobile number and the specified signature password
  2. Receipt of a text message containing a specific reference number for unique identification and a TAN code
  3. Entering the TAN code and signing the document

Once set up, contracts can be digitally signed in a legally valid manner from your computer, laptop or smartphone. The set-up process takes just a few minutes. After providing your personal details and completing a brief video call for verification, you will receive a TAN via text message, and you’ll be ready to go.
